Frequently Asked Rideshare Accident Questions

Does Uber or Lyft's insurance cover my accident?

It depends on the driver’s status at the time of the crash. If the driver was actively transporting a passenger (Period 3) or en route to a pickup (Period 2), Uber and Lyft provide up to $1 million in liability coverage plus UM/UIM and contingent comp/collision. If the driver had the app on but hadn’t accepted a ride (Period 1), coverage drops to $50,000 per person / $100,000 per accident. If the app was off (Period 0), there’s no rideshare company coverage at all — only the driver’s personal insurance applies. Determining which period applied at the moment of the crash is one of the most critical steps in your case.

Can I sue Uber or Lyft directly after an accident?

Generally, no. Uber and Lyft classify their drivers as independent contractors, which typically shields the companies from direct lawsuits. However, you can file a claim against the rideshare company’s insurance policy, and in some cases, you may be able to argue that the company was negligent in its screening, training, or supervision of drivers. An experienced rideshare accident attorney can evaluate whether a direct claim against the company is viable in your specific case.

What should I do after an Uber or Lyft accident?

Call 911, get medical attention, and — critically — take a screenshot of your Uber or Lyft app showing the ride details (driver name, photo, vehicle info, trip status, and route) before closing the app. Document the scene with photos, collect contact information from all drivers and witnesses, and do not give a recorded statement to any insurance company without first consulting an attorney. Contact a rideshare accident lawyer immediately so they can send preservation demands for app data and digital evidence.

What compensation can I recover after a rideshare accident?

Rideshare accident victims can seek compensation for medical expenses (current and future), lost wages and diminished earning capacity, pain and suffering, emotional distress, property damage, and loss of enjoyment of life. The total recovery depends on the severity of your injuries, which insurance policies apply based on the driver’s app status, and whether the rideshare driver or another driver was at fault. An experienced attorney can identify and pursue all available sources — including stacking multiple policies to maximize your total compensation.

What if the Uber or Lyft driver had the app off when the accident happened?

If the driver’s app was off (Period 0), Uber and Lyft provide zero coverage. The claim would go through the driver’s personal auto insurance. However, many personal auto policies exclude coverage when the vehicle has been used for commercial rideshare purposes, potentially creating a coverage gap. In this scenario, your own uninsured/underinsured motorist (UM/UIM) coverage may be your most important source of compensation. Jordan Law conducts a thorough review of every available policy to identify the best path to recovery.

How much does it cost to hire a rideshare accident lawyer?

Jordan Law handles rideshare accident cases on a contingency fee basis. You pay nothing upfront and owe no attorney fees unless we recover compensation for you. Given the insurance complexity of rideshare cases — where multiple policies and coverage tiers are in play — having an attorney involved from day one can make a significant difference in your total recovery. Consultations are always free.

What's My Uber or Lyft Case Worth?

The value of your case depends on your injuries and other losses, like medical bills and missed work.

Will my case go to trial?

Most cases settle outside of court, but if needed, we will take your case to trial to get you fair compensation.

What if the at-fault party doesn’t have insurance?

Uber and Lyft have insurance that might cover your injuries, even if the other driver doesn’t have insurance.
