Who can file a wrongful death claim after a fatal car accident in Colorado?

Colorado law establishes a priority order. During the first year after death, only the surviving spouse may file. In the second year, children, beneficiaries, or parents may file if the spouse has not. Under HB 24-1472 (effective January 1, 2025), siblings may now also file in certain circumstances. If no family member files, the estate representative may bring the claim.

How long do I have to file a fatal car accident wrongful death claim?

The statute of limitations for wrongful death in Colorado is two years from the date of death — not three years like a personal injury claim. In hit-and-run vehicular homicide cases, the deadline may extend to four years. Do not wait — critical evidence like EDR data and surveillance footage can disappear within days.

What is the felonious killing standard in Colorado?

Under HB 24-1472, when a death is caused by a felony (such as vehicular homicide while DUI), there is no cap on noneconomic damages. This is a significant change from prior law, where all wrongful death noneconomic damages were capped regardless of how egregious the conduct. Building a case to the felonious killing standard requires specific evidence and legal strategy.

What is the difference between a criminal case and a wrongful death lawsuit?

They are separate proceedings. The criminal case is brought by the district attorney and seeks punishment (jail time, fines). The wrongful death lawsuit is brought by surviving family members and seeks financial compensation. A criminal conviction can be used as evidence in the civil case, but you don’t need a conviction to win a wrongful death claim — the civil standard of proof is lower.

What compensation is available in a fatal car accident case?

Surviving family members may recover medical expenses incurred before death, funeral costs, lost future income, loss of companionship and guidance, grief and emotional anguish, and punitive damages in cases involving reckless conduct. Economic damages have no cap. Noneconomic damages are capped at $1.5 million under HB 24-1472, with no cap in felonious killing cases.
