Colorado Statute of Limitations for Product Liability Cases

Why Acting Quickly After a Product Injury Matters

If you’ve been injured by a defective product in Colorado, time is not on your side. State law gives you a limited window—known as the statute of limitations—to file a product liability claim.

Missing this deadline can permanently prevent you from seeking the compensation you deserve for your injuries. At Jordan Law, we help injury victims understand their rights and take timely legal action against negligent manufacturers, distributors, and sellers.

What Is the Statute of Limitations?

The statute of limitations is the legal deadline for filing a lawsuit. In Colorado, most product liability claims must be filed within two years of the injury date.

If you miss this deadline, the court can dismiss your case—no matter how strong your evidence may be.

This strict rule exists to ensure cases are handled while evidence and witness testimony remain reliable.

When Does the Clock Start?

In most cases, the two-year period begins on the date of the injury. However, Colorado law recognizes several important exceptions that can extend or delay this deadline.

1. The Discovery Rule

If the injury or defect wasn’t immediately obvious, the clock may start later—on the date you discovered (or reasonably should have discovered) the defect. Example: A defective medical implant causes internal injuries that aren’t diagnosed until months after surgery.

2. Minors and Incapacitated Victims

If the injured person is a minor or mentally incapacitated, the statute of limitations can be paused (“tolled”) until they reach adulthood or regain capacity.

These exceptions are complex, which is why it’s crucial to consult a product liability attorney early to confirm how the law applies to your situation.

Why You Shouldn’t Wait to Take Action

Delaying your claim can have serious consequences.

  • Lost Compensation: You may lose the right to recover money for medical care, lost income, or pain and suffering.

  • Evidence Deterioration: Physical evidence like the defective product, packaging, or receipts can be lost or destroyed over time.

  • Weakened Negotiating Power: Insurance companies may assume you’re unprepared or uncertain and use delays to their advantage.

“The sooner we can investigate, the stronger your case will be,” says Attorney Anne Dieruf, Jordan Law’s product liability attorney. “Preserving evidence early allows us to prove what went wrong and who should be held accountable.”

How to Protect Your Rights

If you believe a defective product caused your injury, take these steps right away:

  1. Preserve the Evidence
Keep the product, packaging, manuals, and receipts. Store them safely and do not attempt repairs.

  2. Document Your Injuries
Take photographs, keep detailed medical records, and track all related expenses.

  3. Contact an Experienced Attorney
A Colorado product liability lawyer can ensure your claim is filed correctly and within the statute of limitations.

At Jordan Law, our attorneys focus exclusively on personal injury cases—not property-damage-only claims.
We have decades of trial experience representing clients hurt by dangerous products, defective equipment, and corporate negligence.

What Happens After You File

Filing on time is the first step toward justice. Once your claim is submitted, your legal team will:

  • Investigate the product defect and gather supporting evidence.

  • Negotiate with manufacturers, distributors, and insurers.

  • Take your case to court if a fair settlement isn’t offered.

Filing before the deadline ensures your voice is heard and your right to compensation is preserved.

Don’t Miss Your Window for Justice

If a defective product has caused you serious harm, don’t wait.
Colorado’s statute of limitations moves quickly—and once it expires, your claim is gone for good.

Let Jordan Law handle the legal details while you focus on recovery.
