Things That Could Sabotage Your Injury Claim

After suffering a personal injury as the result of a person’s negligent actions, you will need to file a claim to pursue monetary compensation. There are many mistakes that you can make that will ruin your case and prevent you from recovering the compensation you rightfully deserve. Even simple mistakes can be made that will entirely sabotage your case. On a positive note, doing the reverse of these actions can help prevent the insurance agent from stonewalling. Here are the mistakes you should avoid making:

Lying: When filing a claim, always resort to telling the truth. Do not even attempt to stretch the truth. Providing false information on your claim can void the personal injury lawsuit and will bar you from recovering the compensation you could have otherwise collected.

Discussing Your Case: Do not talk about your case to anyone except your lawyer. You should especially avoid speaking to an insurance adjuster, the other party’s lawyer, a juror. Always refer questions to your attorney. Talking about your case with others can give away important details that should not be disclosed.

Posting on Social Media: Be very careful when using social media. Insurers can use pictures and your status updates to show that you are not as injured as you claim. Be careful if you post anything, especially details about your activities.

Waiting Too Long to File: Colorado has a 2 year statute of limitations for filing a personal injury claim. This includes car accidents, slip and falls, toxic torts, and other types of cases involving another’s negligence. If you wait too long to start filing, you will miss the opportunity.

Failing to Follow Medical Advice: It is essential that you go to the doctor and follow through with the medical advice provided. Failure to take the medications required or completing exercises can prove disastrous in your case. If you miss appointments, the insurer can use this as evidence that you were not truly as injured as you claim.
