Can I recover damages if I wasn't wearing a helmet?

Yes. Colorado does not require adult cyclists to wear helmets, and not wearing one does not bar your claim. However, the insurance company may argue that a helmet would have reduced your head injuries, potentially reducing your noneconomic damages.
