Frequently Asked Burn Injury Questions

What qualifies as a burn injury claim?

Any burn injury caused by another party’s negligence, recklessness, or a defective product may qualify for a personal injury claim. Common examples include workplace fires and explosions, vehicle accidents resulting in fire, defective appliances or equipment, chemical exposure, restaurant kitchen accidents, and residential fires caused by faulty wiring or landlord negligence.

How much is a burn injury case worth?

It depends on the severity of the burn, the percentage of body affected, the number of surgeries required, the long-term disfigurement, and the impact on your ability to work and live independently. Severe burn cases routinely result in settlements and verdicts in the millions. Jordan Law recovered $26.6 million for a catastrophic deep fryer burn victim and $20 million for a fuel tanker explosion victim.

What are the degrees of burn severity?

First-degree burns affect only the outer skin layer. Second-degree burns damage the first and second skin layers, causing blisters and scarring. Third-degree burns destroy the full thickness of the skin and require surgical treatment including skin grafts. Fourth-degree burns extend into fat, muscle, tendon, and bone — these are the most severe and often result from explosions or prolonged fire exposure.

How long do I have to file a burn injury lawsuit in Colorado?

The deadline depends on the cause of the burn. Motor vehicle fires carry a three-year statute of limitations under C.R.S. § 13-80-101. Workplace burns, premises liability, and product defect claims generally have a two-year deadline under C.R.S. § 13-80-102. If a government entity is involved, notice may be required within 182 days. Contact an attorney immediately to confirm your specific deadlines.

Can I file a burn injury claim if I was injured at work?

Yes. You may be entitled to workers’ compensation benefits and also have a separate personal injury claim against a third party whose negligence caused the burn — such as an equipment manufacturer, a property owner, a subcontractor, or a chemical supplier. Workers’ compensation and third-party personal injury claims are separate and can be pursued simultaneously.

How much does it cost to hire a burn injury lawyer?

Jordan Law handles burn injury cases on a contingency fee basis. You pay nothing upfront and owe no attorney fees unless we recover compensation for you. We invest in fire investigators, medical experts, and life care planners at our own expense. Consultations are always free.

How Do I find a Good Burn Injury Lawyer?

In short, the best way to find a personal injury lawyer is to start with a list of attorneys in your area. You can create a list by going to Google, Avvo.com or calling your local bar organization. From there, research the attorneys. Use their website, look at their Google reviews, etc. Narrow down your list to the top three attorneys. Schedule free consultations with each and interview them.
